Canonical Criminal Law is responsible for legislating on offenses or crimes within the Church, establishing procedures for judging the accused and punishing the guilty in order to restore justice and peace.
Crimes in the Church infringe on the rights of persons, hinder the mission, break communion and offend God. They may involve supernatural goods (such as the Word of God, the sacraments or the good ecclesiastical governance) or natural goods related to the mission (such as the life, liberty or integrity of persons), or both types of goods simultaneously.
Among the most common crimes are apostasy, heresy, schism, abuse of power, sexual abuse, economic corruption, profanation of the Eucharist, violation of the secrecy of confession, slander, falsification of documents, among others.
As a Canon Lawyer and Advocate of the Roman Rota, I defend your rights at all hierarchical levels of the Church and help you obtain reparation for damages.
Canonical Administrative Law encompasses the set of laws that regulate public administration and the management of pastoral government in the Church. These norms seek to eliminate arbitrariness in the actions of ecclesiastical authorities, ensuring good governance at the service of the salvation of souls.
The hierarchical recourse — similar to a judicial appeal — is the most effective instrument for protecting the rights of individuals before the public administration of the Church. It is used against decisions of ecclesiastical authorities that cause unjust harm.
Some of the most common issues are the incardination and excardination of clergy, the removal or transfer of pastors, the expulsion of members of institutes of consecrated life, the prohibition to exercise the priesthood or diaconate, the denial of priestly ordination to deacons, the removal of jobs, the imposition of precautionary measures or administrative penal sanctions, the appointment of commissaries for institutes, the suppression of associations or parishes, the reparation of damages, among others.
As a Canon Lawyer and Advocate of the Roman Rota, I defend your rights at all hierarchical levels using the legal instruments that the Church offers.
Canonical Patrimonial Law comprises the set of laws that regulate the temporal goods of the Church. These norms seek to ensure that the ecclesiastical patrimony is used for the salvation of souls, especially to sustain divine worship, to provide honestly for the clergy and other ministers, and to develop works of apostolate and charity.
Some of the most common issues are offerings, fees and taxes, collections, remuneration and social assistance of the clergy, support of members of religious institutes, union, division or extinction of juridical persons, contracts, purchase, administration or sale of real estate belonging to dioceses, parishes and institutes of consecrated life, donations and pious foundations, among others.
As a Canon Lawyer and Advocate of the Roman Rota, I advise you on how to proceed in each of these situations. If you have a problem, I mediate between the parties to reach a fair patrimonial solution. And, if necessary, I represent you in all ecclesiastical instances to defend your rights.
Canonical Marriage Law is the set of Church Law that regulates the sacramental union between a man and a woman.
Marriage nullity proceedings in ecclesiastical tribunals seek to verify whether the necessary requirements for the validity of a marriage have been met.
The conjugal bond is established at the moment of the wedding celebration, when the bride and groom express their will to give themselves to each other in an irrevocable alliance and agree to form a consortium for life. However, in certain cases, this bond may not be established due to different reasons stipulated by Canon Law, such as vices of consent (psychological incapacity, lack of freedom, simulation), impediments to contracting marriage (lack of legal age, sexual impotence, previous marriage) or defects in the form of the celebration (lack of authorization, absence of witnesses).
Declaring the nullity of a marriage is an act of justice that allows the spouses to live in accordance with their sacramental reality. This implies living as married if the bond is valid or, in the case of a declaration of nullity, opening the possibility of a new marriage.
As a Canon Lawyer and Advocate of the Roman Rota, I accompany and defend you in all instances of this process of discernment and clarification of your sacramental and family situation.
